General Acceptable Use Policy:

This AUP governs the utilization of ProtozoaHost’s hosting service. Violation of this AUP may lead to suspension or termination of your service. In case of any dispute regarding the interpretation of this AUP, ProtozoaHost’s reasonable commercial judgment shall prevail.

The following constitutes the entire Acceptable User Policy (“AUP”) agreement between ProtozoaHost and the personal or corporate account holder. ProtozoaHost provides managed web hosting and domain name services. We uphold legal and ethical responsibilities in conjunction with the use of our servers and equipment involved in these services. Our primary role is to offer Internet presence. ProtozoaHost reserves the right to suspend or cancel a customer’s access to any or all services provided by ProtozoaHost if we determine inappropriate usage.

Appropriate Usage:

ProtozoaHost’s web hosting solution is specifically tailored to meet the needs of small, independently owned businesses, and organizations worldwide. As our service operates on shared servers, it may not adequately support enterprise-level or large company requirements. For such cases, we recommend considering a virtual private server, cloud, or dedicated server solution.

Our hosting is shared, which means multiple customers’ websites are hosted on the same server environment. We prioritize delivering top-notch, reliable, and available hosting to all customers within that community. Therefore, individual website usage should not negatively impact others’ site performance. Our servers are continuously monitored, and any measures necessary to safeguard the entire community will be taken if required.

Lastly, our web hosting service is intended for hosting websites, not for data backup or storage purposes. Using your hosting account primarily as an online storage facility for archiving electronic files and images is strictly prohibited. Our servers are dedicated to web hosting usage only.

Offensive Content:

You may not publish or transmit via ProtozoaHost’s service any content that ProtozoaHost reasonably believes:

1. Involves child pornography or pornography.
2. Contains excessively violent, harassing, or hate speech content that incites violence or threats.
3. Is deceptive, such as chain letters or pyramid schemes, violating consumer protection laws.
4. Defames or violates a person’s privacy.
5. Poses a risk to safety, health, or public safety, compromises national security, or interferes with law enforcement investigations.
6. Improperly exposes trade secrets or confidential information of others.
7. Aids in defeating technical copyright protections.
8. Clearly infringes on someone’s trademark, patent, or other property rights.
9. Promotes illegal drugs, violates export control laws, involves illegal gambling, or arms trafficking.
10. Is otherwise illegal or solicits illegal conduct under applicable laws.

ProtozoaHost does not accept material such as:

Proxy, Warez, Escrow, High Yield Investment Programs (HYIP), Multi-level marketing (MLM), Gaming servers/applications, illegal Gambling, and Lottery sites.

ProtozoaHost reserves the right to terminate service for any of the above reasons, and refunds, if applicable, will be issued at ProtozoaHost’s sole discretion.

Security:

You are required to take reasonable security measures to protect your account. Safeguard the confidentiality of your password and consider changing it periodically.

Bulk Commercial Email:
You may use bulk commercial email, mailing lists, and email reflectors on ProtozoaHost’s servers, with a maximum limit of 500 emails per hour per account. However, when sending emails from your ProtozoaHost account, adhere to the following guidelines:

1. Obtain explicit consent from your intended recipients to receive emails (opt-in procedure).
2. Ensure the consent process verifies the ownership of the provided email addresses.
3. Do not obscure the source of your emails.
4. Comply with the CAN SPAM Act and other applicable laws.

These policies apply to emails sent using your ProtozoaHost service or sent from any network on your behalf that directs recipients to a site hosted via your ProtozoaHost service. Additionally, avoid using third-party email services that do not follow similar procedures for all their customers.

Unsolicited Email:

Sending unsolicited bulk or individual emails to individuals who have expressed their unwillingness to receive such communication is strictly prohibited. You must also abide by the rules of any other network you access or participate in while using ProtozoaHost’s services.

Material Protected By Copyright:

You are prohibited from publishing, distributing, or copying any copyrighted music, software, art, or other protected work, unless you have explicit authorization from the copyright owner or are permitted by established United States copyright law to do so. ProtozoaHost will terminate the service of users who repeatedly infringe copyright laws.

Other:

Ensure that valid and current information is on file with your domain name registrar for any domain hosted on the ProtozoaHost network.

Disclaimer:

ProtozoaHost is not obligated to monitor or police customer activities and disclaims responsibility for any misuse of the ProtozoaHost network.

Internet Abuse:

Engaging in unauthorized access, monitoring, interference, or use of data, systems, or networks without proper authorization is strictly prohibited. Any conduct that may result in retaliation against the ProtozoaHost network is not allowed.

Unreasonable Interference:

Using ProtozoaHost’s network in a manner that unreasonably interferes with other customers’ use of the network is not permitted.

Newsgroup, Chat Forums, Other Networks:

Comply with the rules and conventions of any bulletin board, chat group, or forum in which you participate, including IRC and USENET groups, which may prohibit off-topic commercial messages or mass postings.
